Terms & Conditions
1. Introduction
These Terms & Conditions apply to all fencing installation and related services (“the Services”) provided by Hardman Oakley Ltd, trading as Hardman Oakley Fencing (“the Company”), to the customer (“the Client”). By accepting a quotation or allowing work to commence, the Client agrees to these terms.
2. Quotations and Work
2.1. All quotations are valid for 30 days unless stated otherwise.
2.2. Any variations, additions, or unforeseen work required will be quoted separately and must be agreed before proceeding.
2.3. The Company will carry out the Services with reasonable skill and care and in accordance with relevant UK standards.
3. Materials and Natural Products
3.1. Timber is a natural material. The Client acknowledges that wood may be subject to natural warping, splitting, shrinkage, colour variation, and movement over time.
3.2. These characteristics do not constitute defects, and the Company accepts no liability for such natural changes.
4. Site Conditions
4.1. The Client is responsible for ensuring that the site is accessible, clear, and safe for work to begin.
4.2. The Company is not liable for damage to underground services unless their presence and position have been clearly identified by the Client in advance.
5. Payment Terms
5.1. Payment is due within 5 days of invoice, unless otherwise agreed in writing before work begins.
5.2. Materials remain the property of Hardman Oakley Ltd until full payment has been received.
5.3. The Company reserves the right to remove materials or suspend work if payment is not received within the agreed timeframe.
6. Cancellations
6.1. If the Client cancels after materials have been purchased or work has begun, the Company reserves the right to charge for costs incurred.
7. Guarantees and Liability
7.1. Installed fencing is guaranteed against workmanship defects for 12 months unless otherwise stated.
7.2. The guarantee does not cover damage caused by storms, vandalism, neglect, or natural material movement as described in Section 3.
7.3. The Company’s total liability shall not exceed the total contract value.
8. Complaints
Any concerns should be raised with the Company in writing within 7 days of the issue being identified. The Company will respond promptly and work to resolve the matter fairly.
9. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be dealt with by the courts of England and Wales.
